Case file retention and disposition

Purpose

This policy explains how the Social Security Tribunal of Canada (SST) manages the retention and disposition of its case files. Retention is how long we keep case files and disposition is how we safely destroy them when we no longer need them.

The policy establishes a consistent and transparent approach to managing case files that is in line with the SST’s Open justice and privacy policy.

What this policy applies to

This policy applies to General Division and Appeal Division case files stored electronically in our case management system. We don’t use paper files.

How long we keep case files

We keep case files for 10 years after the date the file is closed. A case file is closed when a final decision has been made on the appeal or when the appeal is withdrawn. After 10 years, case files are permanently deleted.

Exceptions

We publish Appeal Division decisions and some General Division decisions. Published decisions will stay available on our website and on CanLII opens a new window. CanLII is an organization that provides open access to court and tribunal decisions.

Effective date

This policy takes effect on March 16, 2026.
