Respondents

The respondent is defending the decision that’s being appealed. 

At the General Division (first level of appeal), the respondent is always the government (the Canada Employment Insurance Commission or the Minister of Employment and Social Development Canada).

At the Appeal Division (second level of appeal):

  • If you lose your appeal at the General Division and you want to appeal that decision to our Appeal Division, the respondent is once again the government.
  • If you win your appeal at the General Division and another party disagrees, you become the respondent if the other party appeals that decision to the Appeal Division. If this happens, we’ll notify you in writing.
